To avoid the recapture rule, alimony payments should not drop by more than $15,000 between the second year of payments and the third year of payments. Additionally, although the drop in alimony from the first year of payments to the third year of payments can exceed $15,000, payments for the first year should not be more than $15,000 larger than the average of the payments for the second and third years.
